Type 07 FFL Overview

The Type 07 FFL authorizes the manufacture of firearms other than destructive devices. The Type 07 also permits all activities allowed under a Type 01 dealer license, including retail sales and firearm transfers.

The initial application fee for a Type 07 FFL is $150, with renewal fees of $150 every three years. This makes it one of the more affordable FFL types despite its broad manufacturing authorization. The relatively low cost has made Type 07 licensing attractive for small manufacturers, custom builders, and gunsmiths who assemble firearms from components.

Applicants must meet standard FFL requirements including being at least 21 years old, having no felony convictions, and maintaining a premises suitable for conducting business. The ATF conducts background checks and on-site inspections before issuing licenses.

Manufacturing vs. Gunsmithing

The distinction between manufacturing and gunsmithing determines which license type a business needs. A Type 01 FFL covers gunsmithing activities where the work returns to the same customer who brought the firearm in. Repairs, customization, refinishing, and fitting parts to customer-owned firearms fall under gunsmithing.

Manufacturing occurs when a business creates firearms for sale, assembles receivers into complete firearms for commercial purposes, or routinely modifies firearms for resale rather than returning them to the original owner. A gunsmith who builds custom rifles from actions the business owns needs a Type 07, not a Type 01.

The ATF has taken the position that assembling AR-style rifles from components constitutes manufacturing, requiring a Type 07 license even when no machining occurs. Businesses that purchase receivers and assemble them into complete firearms for sale should obtain manufacturing licenses.

Adding Class 2 SOT Status

Manufacturers who want to produce items regulated under the National Firearms Act must add Class 2 Special Occupational Taxpayer status to their Type 07 FFL. The Class 2 SOT authorizes manufacturing of suppressors, short-barreled rifles, short-barreled shotguns, and machine guns.

The annual SOT fee is $500 for businesses with gross receipts under $500,000, or $1,000 for larger operations. Unlike the FFL which renews every three years, SOT status requires annual payment. The SOT runs on a July 1 to June 30 fiscal year regardless of when the manufacturer initially registers.

Machine guns manufactured under Class 2 SOT status cannot be sold to civilians due to the 1986 Hughes Amendment. They can only be sold to law enforcement, military, or other licensed dealers and manufacturers. However, suppressors, SBRs, SBSs, and other NFA items can be sold to eligible civilians through the standard NFA transfer process.

Record-Keeping Requirements

Type 07 manufacturers must maintain detailed records beyond standard dealer requirements. The Acquisition and Disposition log must track all firearms manufactured, including documentation of when raw materials became firearms. Manufacturers must record the date of manufacture, firearm type, caliber, model, and serial number for every firearm produced.

Marking requirements mandate that manufacturers engrave or mark each firearm with the manufacturer name, city and state of manufacture, and a unique serial number. These marks must meet specific depth and size requirements to ensure durability and legibility.

Annual manufacturing reports submitted to the ATF document production volumes by firearm type. These reports help the ATF track manufacturing activity and ensure compliance with licensing terms.

Excise Tax Obligations

Understanding whether firearms manufacturers need to pay excise taxes is essential for compliance and business planning. Federal excise taxes apply to firearms and ammunition manufactured for sale, with rates varying by product type.

ITAR Considerations

The International Traffic in Arms Regulations historically required all firearms manufacturers to register with the State Department and pay annual fees, even those with no export activity. Recent regulatory changes have reduced this burden for manufacturers of commercially available firearms and ammunition.

Manufacturers producing standard commercial firearms may no longer need ITAR registration.
